Sportech claims victory in ‘Spot the Ball’ VAT case

The Court of Appeal Judges has ruled unanimously in favour of Sportech in the company’s appeal case relating to a £97 million (€122.3 million/$140 million) VAT repayment claim on its ‘Spot the Ball’ game.

In 2013, the First-Tier Tribunal ruled in favour of Sportech in a VAT case relating to Spot the Ball, with the operator receiving a payment of £93 million from Her Majesty’s Revenue & Customs (HMRC).
However, the decision was then reversed in September 2014 when Sportech was ordered to repay the money following an appeal lodged by HMRC.
Sportech in January said a hearing for its appeal had been set for April, following the postponement of an earlier date in November due to a “lack of judicial availability”.
HMRC now has until May 13 to apply for permission to appeal to the Supreme Court.
